ONE Media Communications will provide the exact work outlined in the Done-for-You Website package.
Anything out of scope will need to be documented and evaluated by a project manager and quoted accordingly. Once the client reviews and approves the work will continue.
ONE Media Communications and the client both receive the right to cancel the project. ONE Media Communications will track the hours spent on the work at our standard $300 hourly rate and will then provide an analysis of the work performed and will refund any amount that of the funds that have not been utilized.
If the client pauses the project for any reason such as addressing other business commitments, taking care of other priorities such as family, etc. ONE Media Communications reserves the right to charge a $300 "project re-start" fee. This is to prevent the project from taking longer than agreed to. Our goal is simple and that is to respect your time and to respect ours. We don't like to charge a $300 "project re-start" fee but we have this in place to avoid project delays.
The client or company that paid for the website is the full owner of the website. Once the website is approved and launched it is 100% property of the client and not of ONE Media Communications.
After your website is approved of and launched ONE Media Communications is not responsible if any edits are made by the client or a third party. Moreover, due to the constant changes of technologies such as Google, Content Management Systems such as WordPress, Elementor, Webfloe, SquareSpace, Wix and other platforms and companies ONE Media Communications cannot be held responsible. ONE Media Communications does however provide monthly maintenance services to support clients with the constant changes in technology.
ONE Media Communications does not guarantee any business growth. Due to the nature of business such as the macro and micro economy results in terms of lead generation and sales vary by business. There are many variables that can determine the success of a business in terms of sales such as the brand awareness of the company the reputation, the quality of the products and services and the offers the company sells. Due to all of the variables and others ONE Media Communications is not responsible for the success of your business. We do offer marketing services such as the Done-for-You Website to help businesses get online and have a professional website presence but we do not take any responsibility in terms of your business growth and success.
If either party accuses the other of being in breach of contract, there is a 30 calendar day period for the accused party to address the breach within 30 days. If an agreement cannot be reached the Ventura County Small Claims courthouse will serve as the only location for litigation. ONE Media Communications is not responsible for any client costs associated with the litigation.
